He’s calling it a major victory for South Dakota and two dozen other states. Attorney General Marty Jackley is celebrating a temporary injunction that halts the Waters of the United States rules from taking effect. It would require federal approval for private landowners to utilize waterways on their own property. Jackley says the top-down approach of the rule is heavy handed, and unnecessary. Additionally, the Attorney General say the plan is not workable for farmers, ranchers, and even for communities working on development plans. He says the bureaucracy of the Federal Government would create headaches, delays and steals property rights from individuals.
Attorney General Jackley was one of two dozen attorneys general to file the suit to stop the plan. A federal judge in North Dakota issued a temporary injunction halting the plan’s implementation. Jackley and his colleagues are hoping the ruling becomes permanent. The injunction means the judge hearing the case believes there’s a good chance the states will prevail in the dispute.
